Ogundokun vs Oluwo: Court affirms jurisdiction.

Osun State High Court of Justice sitting in Osogbo has on Friday affirmed its jurisdiction over the matter brought before it by Chief Abiola Ogundokun against Oluwo of Iwo land, Oba Abdulrafiu Adewale Akanbi and the Board of Trustees of Iwo central mosque.

Counsel to Oluwo Akanbi has posited through affidavit, statement and address that the court as a vacation court does not have any jurisdictional right to hear or entertain the matter as there is no any urgency deposed to my Chief Ogundokun counsel.

However, counsel to chief Ogundokun argued that affidavit, statement and address has shown in the court records meets all these.

It would be recalled that the court has earlier granted an interlocutory injunction restraining Oluwo Akanbi from presiding over Friday mosque and Eid prayers in Iwo pending the determination of motion on notice.

The court presided over by Justice A.O. Ayoola in her judgment on the motion on notice ruled that the court have jurisdiction over the matter as all the prerequisite of law has been satisfied by Ogundokun’s counsel.
